Who must comply?
Those who create official Eastern Kentucky University (EKU) pages
- A University web page is considered official when it is published by a campus, school, department, or an administrative unit of the University.
Web pages published by faculty, staff and students
- Faculty, staff, and students' web pages used for academic and administrative duties and activities.
- Blackboard or other online learning materials.

Exceptions
Personal Student and Faculty web pages are exempt unless they provide essential information to the public, students, faculty and staff. For example, if an instructor places course information in his or her personal web space for students, the pages must be accessible.
Legal
The Americans with Disabilities Act of 1990 (ADA) and Sections 504 and 508 of the Rehabilitation Act of 1973 require that individuals with disabilities receive equal access to programs, services and activities unless doing so would fundamentally alter the nature of the program, service or activity or such access would impose an undue burden.
In 2000, the Kentucky General Assembly passed a far-reaching law, commonly called the Kentucky Accessible Information Technology (AIT) Act, KRS 61.980 - 61.988, which requires that all state-supported institutions utilize information technology resources that are accessible to people with disabilities. This law explicitly covers school districts, universities, and all other institutions supported with state funds.
Accountability
- EKU Web Services (Public Relations and Marketing) is responsible for producing and maintaining the accessibility features of the University's main web pages and all associated templates.
- Online Learning (ITDS) and Distance Education (Continuing Education & Outreach) are jointly responsible for the accessibility of online courses.
- Web authors, including instructors, are responsible for the accessibility of documents they create and edit.
- Departments in each College area must designate at least one member (faculty or staff) to be the contact for accessibility.
Compliance
When web pages are found to be noncompliant:
- The web page owner and publisher will be notified and asked to correct problems
- If problems aren't corrected, EKU may make corrections. Corrections may require page removal.
